As of April 2023, there is no news that Justine Winter has died. She was convicted, however, of murdering a mother and her 13-year-old boy in 2009 after she collided with their car while traveling at 85 mph.
She was convicted of two counts of intentional homicide and was granted parole in 2021 after serving years in jail.
According to the lawsuit, Winter sustained lasting injuries in the incident and a “loss of capacity to enjoy life.” She also claims future income loss and past, present, and future medical expenditures.

The claim, filed last month in Flathead County District Court, lists Thompson’s estate as defendants, with her husband Jason Thompson serving as a representative and three businesses operating and offering services on Highway 93.
The Winter or Thompson families could not be reached for comment. Winter’s attorneys, David Stufft and Maxwell Battle Jr. did not respond to several requests for comment.
Flathead County Attorney Ed Corrigan, who is prosecuting Winter’s criminal case, told ABCNews.com that Winter’s lawsuit might begin her defense.
“I wouldn’t be shocked if there was an attempt on their behalf to induce a change of venue or put pressure on the state to settle it,” he added. “I can’t guess what they’re thinking, but it may be some kind of plan.”
“I’m afraid that the lawsuit being brought will inflame the public in what is already a well-known situation for us,” he continued.

Montana State Trooper Dustin LaRette, who arrived on the site the next day to reconstruct the accident, stated the road work that was taking place at the time of the tragedy dropped the speed limit from 65 to 55.
According to the criminal complaint, neither road conditions nor drinking was a factor in the incident.
“That was a severe crash,” stated LaRette. “It’s among the worst ones I’ve seen.”
