Martha Koome Got Sued Once In 2022
In May 2022, a lawyer named Omwanza Ombati filed a petition at the High Court against Martha Koome’s gag order.
According to him, it prohibits public comments on the presidential election petition.
He argued at the high court that the directive was unconstitutional. The order “limited people’s freedom of speech and expression,” is what he said in the court.
Omwanza wanted to suspend the Gazette Notice on the Supreme Court according to the filed petition.
However, CJ Martha Koome defended the gag order, stating that the Presidential Election Petition Rules were only aimed at protecting judicial integrity.
Omwanza Ombati filed the petition mainly because he felt that the gag order limited media freedom.
People were only allowed to broadcast and publish articles on the Presidential Election Petitions with an allowance from the Upper Body of Executives.
CJ Martha then met with the Law Society of Kenya to review her amendments to the Supreme Court Rules.
She stated that the decision was liberal and the amendment had no objective of suppressing the Kenyan Human Rights to Expression.
