Daniel Penny, a West Islip High School graduate, served in the Marines from June 2017 to June 2021, belonging to the 1st Battalion, 2nd Marines and 2nd Marine Division, with his final posting at Camp Lejeune in North Carolina.

Previously, he received five medals, including the Marine Corps Good Conduct Medal, the Humanitarian Service Medal, two Sea Service Deployment Ribbons and the Global War on Terrorism Service Medal.

Penny withdrew from the Marines in 2021 and posted on a job board for the service sector, expressing his passion for helping and communicating with people from diverse backgrounds.

He reportedly attended college but left as he felt unfulfilled and instead backpacked in Central America.

Daniel Penny, a former U.S. Marine filmed putting Jordan Neely in a fatal chokehold on a New York City subway train, released his first statement through his lawyers on May 4, 2023.

According to Penny’s lawyers, he did not intend to cause harm to Neely and could not have anticipated the tragic outcome of the incident.

Therefore, it would not be appropriate to categorize him as racist solely based on his race or the victim’s race.

The incident involving Neely’s death has sparked a polarizing debate in the city.

Some individuals highlight the escalating levels of violence on public transit, while others perceive it as an indisputable manifestation of racism.

On the other hand, on May 5, 2023, four days after the incident, Penny released a statement defending his actions, stating that he and his fellow passengers acted in self-defense because they feared for their safety.

Protesters took to the NYC subway system to denounce the killing of Jordan Neely, resulting in clashes with Police and at least seven arrests.

On Saturday around 6:30 pm, a video posted on Twitter showed dozens of demonstrators jumping onto subway tracks at Lexington Avenue and East 63rd St, causing a Q train driver to abruptly stop upon entering the station.

On May 3, 2023, a fatal incident occurred on New York City’s F train involving 24-year-old Daniel Penny and 30-year-old Jordan Neely.

In footage of the incident, which independent Journalist Juan Alberto Vázquez recorded, Penny can be seen choking him with his arm around Neely’s head and neck.

Two other men are also seen holding Neely on the subway floor at the Broadway-Lafayette station until he stops moving.

The incident gained attention on social media, with many calling for justice for Neely and demanding that Penny be held accountable.

Similarly, on May 4, The Daily Mail named Penny the assailant, and the NYPD subsequently took him into custody for questioning. However, he was later released without charges, which sparked outrage among progressive users on social media.

Protests & vigils were also held in New York City to honor Neely and demand justice for his death. The circumstances surrounding the incident and Penny’s motives are still under investigation, and it remains unclear whether racial bias played a role.

Further, legal experts say prosecutors in New York are investigating the death of Jordan Neely and could potentially bring manslaughter charges against the subway passenger who choked him to death.

Detectives have interviewed several witnesses and are looking to talk to more. The case will probably be presented to a grand jury to decide if criminal charges are necessary.

Daniel, filmed with his arm around Neely’s neck, has not been charged with any crime and has retained legal representation from attorneys with Raiser and Kenniff.
